Aqib Ali Shah son of Gul
Zahir Shah seeks protective bail in FIR No.8/2020,
registered at P.S. Anti-Encroachment Force, Zone-I, Karachi for offence under
Section 8(1) of the Sindh Public Property (Removal of Encroachment) Act, 2010.
Learned counsel for applicant submits that this Court vid order dated
20.04.2021, admitted the applicant to protective bail, therefore, he
surrendered before the concerned trial Court and trial Court admitted him to
interim pre-arrest bail and he faced trial but due to psychological issues he
remained absent from trial Court. He further submits that after treatment,
applicant is recovered and once again he intends to surrender before learned
trial Court concerned and requests for suspension of NBWs issued against him by
trial Court, in order to enable him to surrender before the trial Court.
Be that as it may, without touching the merits of the
case, protective bail is granted to
applicant/accused Aqib Ali Shah son of Gul
Zahir Shah, for a period of three (3) days from today, subject to furnishing solvent surety in
the sum of Rs.50,000/-
(Rupees fifty thousand) and P.R
bond in the like amount to the satisfaction of the Nazir of this Court. Operation
of NBWs issued against the applicant is suspended for three days. Applicant/accused
is directed to surrender before the trial Court concerned in the aforesaid
period and join the trial forthwith. This order shall cease to have its effect
after expiry of three days from today or whenever applicant/accused surrenders
before the trial Court, which one occurs earlier. It is made clear, in case,
applicant/accused fails to surrender before the trial Court in the aforesaid
period, his bail bond shall stands automatically forfeited.
The instant
criminal bail application is accordingly disposed
of.
