Applicants/accused
are present on interim pre-arrest bail. He seeks
pre-arrest bail in FIR No.323/2024, registered at P.S. Sharafi
Goth, Karachi for offence under sections 379/34, PPC.
2. It is
alleged in the FIR that applicants/accused have stolen refrigerator from the
shop of complainant. After registration of FIR, no recovery has been effected from applicants/accused. Counsel for applicants
submits that applicants have settled their dispute with the complainant,
however, today the complainant is called absent.
3. From
contents of FIR, it appears that case of applicants/accused requires further
inquiry in terms of Section 497(2), Cr.PC. In view of
such position, learned Additional Prosecutor General Sindh has recorded no
objection for confirmation of bail of applicants/accused. Therefore, interim
pre-arrest bail already granted to them by this Court vide order dated
03.01.2025, is hereby confirmed on the same terms and conditions.
The instant criminal bail application is
disposed of in the above terms.
