Through
this constitution petition under Article 199 of the Constitution of Islamic
Republic of Pakistan, 1973, petitioner/accused Muhammad Saeed Alam
son of Muhammad Alam Din, filed through his
attorney, namely, Ghulam Sabir
Ghouri son of Ghulam Hussain Ghouri, seeks protective-cum-transitory
bail in FIR No.185-AFU/DCI/FIR/Unisco/2023 dated 26.09.2023 for offences sections 16,
32,(1), 32(2), 32(A), 79 and 192 of the Customs Act,
1969.
It
is submitted that at present petitioner/accused is at Canada and is prepared to
surrender before the trial Court/Special Judge, Customs & Taxation at Karachi
but he apprehends his arrest at the hands of FIA officials at Jinnah
International Airport Karachi. Air-Ticket is annexed to the petition, which
reflects that petitioner/accused is scheduled to arrive at Jinnah International
Airport, Karachi on 13.05.2024. Serious mala fide on the part of FIA officials
has been alleged.
Since the petitioner/accused
is prepared to surrender before the trial Court, without touching the merits of
the case, petitioner/accused Muhammad Saeed Alam son of Muhammad Alam Din is granted protective-cum-transitory
bail for a period of six (6) days
from today, subject to his furnishing solvent surety in the sum of Rs.100,000/- (Rupees One
Hundred Thousand) and P.R bond in the like amount to the satisfaction of the
Nazir of this Court. Petitioner/accused is directed to surrender before the
trial Court concerned in the aforesaid period. This order shall cease to have
its effect after expiry of six days from today or whenever the petitioner/accused
surrenders before the trial court, which one occurs earlier. In case,
petitioner fails to surrender before the trial Court within the aforesaid
period, his bail bond shall stand automatically forfeited. Let the copy of this
order be sent to the Secretary, Ministry of Interior, Government of Pakistan,
Islamabad, by fax for compliance.
The instant petition is accordingly disposed of.
