            Through this constitution petition under Article 199 of the Constitution of Islamic Republic of Pakistan, 1973, petitioner/accused Muhammad Sohail son of Muhammad Usman, filed through his attorney/cousin, namely, Muhammad Asif son of Ashtamam Khan, seeks protective-cum-transitory bail in FIR No.19/2023, registered at P.S. FIA, Anti-Corruption Circle, Karachi for offences under Section 5(2), PCA 1947, read with Section 156(8)(89) of the Customs Act 1969 read with Section 109, PPC.

            It is submitted that at present petitioner/accused is at Dubai and is prepared to surrender before the trial Court/Special Judge, Central-I, Karachi but he apprehends his arrest at the hands of FIA officials. Air-Ticket is annexed to the petition, which reflects that petitioner/accused is scheduled to arrive at Jinnah International Airport, Karachi on 10.05.2024. Serious mala fide on the part of FIA officials has been alleged.  

Since the petitioner/accused is prepared to surrender before the trial Court, without touching the merits of the case, petitioner/accused Muhammad Sohail son of Muhammad Usman is granted protective-cum-transitory bail for a period of five (5) days from today, subject to his furnishing solvent surety in the sum of Rs.100,000/- (Rupees One Hundred Thousand) each and P.R bond in the like amount to the satisfaction of the Nazir of this Court. Petitioner/accused is directed to surrender before the trial Court concerned in the aforesaid period. This order shall cease to have its effect after expiry of five days from today or whenever the petitioner/accused surrenders before the trial court, which one occurs earlier. In case, petitioner fails to surrender before the trial Court within the aforesaid period, his bail bond shall stand automatically forfeited. Let the copy of this order be sent to the Secretary, Ministry of Interior, Government of Pakistan, Islamabad, by fax for compliance.

            The instant petition is accordingly disposed of.
