            Through this constitution petition under Article 199 of the Constitution of Islamic Republic of Pakistan, 1973, petitioner/accused Lachman Das son of Gomindo Mal, filed through his attorney/brother, namely, Haresh Kumar son of Gomindo Mal, seeks protective-cum-transitory bail in FIR No.M-4263/DCI/Seiz /FIR/Black-Tea/Salam-Food/2024, dated 29.04.2024, registered at the Directorate of Intelligence and Investigation-Customs, Karachi for offences under Sections 2(s), 32, 32A, 79, 178 of the Customs Act, 1969.

            It is submitted that at present petitioner/accused is at Dubai and is prepared to surrender before the trial Court/Special Court Customs and Taxation at Karachi but he apprehends his arrest at the hands of Customs officials.            Air-Ticket is annexed to the petition, which reflects that petitioner/accused is scheduled to arrive at Jinnah International Airport, Karachi tomorrow, i.e. 08.05.2024. Serious mala fide on the part of customs officials has been alleged.  

Since the petitioner/accused is prepared to surrender before the trial Court, without touching the merits of the case, petitioner/accused Lachman Das son of Gomindo Mal is granted protective-cum-transitory bail for a period of four (4) days from today, subject to his furnishing solvent surety in the sum of Rs.100,000/- (Rupees One Hundred Thousand) each and P.R bond in the like amount to the satisfaction of the Nazir of this Court. Petitioner/accused is directed to surrender before the trial Court concerned in the aforesaid period. This order shall cease to have its effect after expiry of four days from today or whenever the petitioner/accused surrenders before the trial court, which one occurs earlier. In case, petitioner fails to surrender before the trial Court within the aforesaid period, his bail bond shall stand automatically forfeited. Let the copy of this order be sent to the Secretary, Ministry of Interior, Government of Pakistan, Islamabad, by fax for compliance.

            The instant petition is accordingly disposed of.
