Learned
advocate for applicant/accused Muzafar Ali alias Mozi does not press the instant criminal bail applications,
however, submits that trial Court may be directed to decide the cases,
expeditiously. It is also pointed out that at present trial Court is lying
vacant. Additional Prosecutor General Sindh as well as advocate for complainant
undertake that all the witnesses shall be produced
before the trial Court on the next date of hearing.
In the
view of above, captioned criminal bail applications are dismissed as not
pressed. Since the trial Court concerned is stated to be lying vacant, Special
Cases Nos.153, 153-A, 153-B, 153-C and 153-D of 2020, pending before
Anti-Terrorism Court-VI, Karachi are withdrawn from the said Court and the same
are made over to learned Administrative Judge, Anti-Terrorism Courts, Karachi
Division, either to try himself or transfer the same to some other Court for
expeditious disposal within two months, under intimation to this Court. In
case, trial is not concluded within two months, counsel for the
applicant/accused would be at liberty to repeat the bail application(s) before
the trial Court, the same shall be decided in accordance with law.
