Appellant and his counsel are called absent. This acquittal appeal pertains to 2021. It appears that this Court vide order dated 17.09.2021 had observed that since the appellant had not appeared, acquittal appeal was adjourned with note of caution in case none appeared on the next date, appeal shall be dismissed on account of non-prosecution. Thereafter, on 21.05.2024 brief was held and acquittal appeal was adjourned. Today, none appeared, no intimation is received. Apparently, appellant is no more interested to pursue the instant criminal acquittal appeal, the same is dismissed on account of non-prosecution along with pending application(s).
