Shah Imroz, advocate, holding brief on behalf of Mr.
Muhammad Nadeem Khan, counsel
for appellant, states that latter is out of station.
Appellant/complainant
Abdul Jabbar has filed this acquittal appeal against
the respondents on 29.11.2022. Counsel for appellant/complainant sought time
for compliance, one week’s time was granted vide order dated 08.03.2023.
Thereafter, notice was issued to the D.A.G. This Court vide order dated
17.05.2023, directed the counsel for appellant to satisfy the Court as to why
this appeal against acquittal be admitted to regular hearing. Thereafter, on
several dates of hearing counsel for appellant did not appear and brief was held.
In
the above stated circumstances, it appears that the appellant is not interested
to pursue the instant acquittal appeal. Today also brief is held that counsel
for appellant is out of station. This acquittal appeal is dismissed on account
of non-prosecution.
