Special Prosecutor ANF contended that bail grant order is
without reasons; trial Court has based order on defence
plea raised by applicant/accused during trial. Lastly, it is submitted that deeper
appreciation of evidence is not permissible at bail stage. We have perused the
bail granting order in which it is mentioned that trial Court has granted bail
to the respondent while observing that medicine, which were recovered from the
possession of applicant/accused, were prescribed by the doctor, respondent
suffers from epilepsy and prescription was verified and counter-signed by the
doctor. In these circumstances, case for cancellation of bail is not made out.
Application for cancellation of bail is dismissed. However, the trail Court is
directed to decide the case expeditiously.
