Moazam Ali son of Naseer
Muhammad seeks protective bail in FIR
No.22/2014, registered at P.S., FIA, CBC, Karachi for offence under
Sections 409, 420, 468, 471, 109, PPC. It is contended that co-accused have
been acquitted by learned Judge (Offences in Banks) Sindh at Karachi vide
judgment dated 18.05.2019 in Case No.29/2014 and the applicant/accused has been
declared as pro-claimed offender. It is further contended that
applicant/accused has no knowledge regarding registration of the aforesaid
case; applicant/accused is prepared to surrender before trial Court but
apprehends his arrest as NBW has been issued against him. Serious mala fide has
been alleged against the complainant FIA officials.
Since the applicant/accused is prepared to surrender
before the trial Court, without touching the merits of the case, protective bail is granted to applicant/accused
Moazam ALi son of Naseer Muhammad for a period of five (05) days from today, subject to furnishing solvent surety in
the sum of Rs.50,000/-
(Rupees fifty thousand) and P.R
bond in the like amount to the satisfaction of the Nazir of this Court. Operation
of NBW issued against the applicant/accused is suspended for five days. Applicant/accused
is directed to surrender before the trial Court in the aforesaid period. This
order shall cease to have its effect after expiry of five days from today or
whenever the applicant/accused surrenders before the trial Court, which one
occurs earlier. It is made clear, in case, applicant/accused fails to surrender
before the trial Court in the aforesaid period, his bail bond shall stands
automatically forfeited.
The instant
criminal bail application is accordingly disposed
of.
