This Court vide order dated 12.08.2024 transferred some References mentioned in the aforesaid order and disposed of instant transfer application to some extent. However, learned MIT-II vide submission Note dated 19.09.2024 has pointed out that fresh list, containing 14 bail applications and 3 miscellaneous application, are pending before Accountability Court No.IV, Karachi, as intimated by learned Incharge Administrative Judge, Accountability Courts Sindh, Karachi. After hearing Special Prosecutor, NAB and for expeditious disposal of the cases, 14 bail applications and 3 miscellaneous applications as mentioned above are hereby withdrawn from Accountability Court No.IV, Karachi and the same are transferred to Accountability Court No.V, Karachi.
It is also pointed out by learned MIT-II that the record of decided cases lying in Defunct Accountability Court No.III, Sukkur shall be consigned to the record room of Administrative Judge, Accountability Courts, Sukkur. In the same manner, record of decided cases lying in Defunct Accountability Court No.III, Hyderabad shall be consigned to the record room of Administrative Judge, Accountability Courts, Hyderabad. Order accordingly.
Learned MIT-II has also pointed out that letter dated 05.09.2024 is received from learned Judge, Accountability Court No.II, Karachi, which shows that 24 References and 1 bail application have already been disposed of by Judge, Accountability Court No.II, Karachi since 22.05.2024 till 12.08.2024 in the capacity of Incharge Administrative judge, Accountability Courts Sindh, Karachi. It may be observed that with regard to 24 References and Bail Application(s), this Court has already passed order dated 12.08.2024 regarding the transfer of the same.
In the view of above, Criminal Transfer Application No.98/2023 is disposed of finally, in the above terms.
