            Petitioner/accused Asif Manzoor son of Manzoor Ahmed Abid, who is presently residing at UAE has filed this constitution petition under Article 199 of the Constitution of Islamic Republic of Pakistan, 1973, for protective/transitory bail, through his duly constituted attorney/wife, namely, Mst. Saira Bano, in Crime No.426/2015, registered at P.S. Site-B, District West, Karachi for offence under section 489-F, PPC. It is inter alia contended by the counsel for petitioner that petitioner intends to surrender before the trail Court but he apprehends his arrest as his CNIC has been blocked, his passport has expired and the trial Court has issued NBWs against the petitioner. Serious mala fide on the part of police has been alleged.  

 

            Since petitioner/accused Asif Manzoor son of Manzoor Ahmed Abid is prepared to surrender before the trial Court, without touching the merits of the case, protective/transitory bail is granted to him for a period of Ten (10) days from today, subject to furnishing solvent surety in the sum of Rs.50,000/- (Rupees Fifty Thousand) and P.R bond in the like amount to the satisfaction of the Nazir of this Court. Petitioner/accused is directed to surrender before the trial Court in the aforesaid period. Operation of NBW issued against the petitioner is suspended for ten days. So far as the CNIC of the petitioner/accused is concerned, it shall be un-blocked till further orders by the trial Court. So far as the passport of the petitioner/accused is concerned, it shall be renewed for 10 days, thereafter, the same shall be deposited by the petitioner before the trial Court concerned. This order shall cease to have its effect after expiry of ten days from today or whenever the petitioner/accused surrenders before the trial Court, which one occurs earlier. In case, petitioner fails to surrender before the trial Court within the aforesaid period, his bail bond shall stand automatically forfeited. Let the copy of this order be sent to the Secretary, Ministry of Interior, Government of Pakistan, Islamabad, by fax for information.

           

            The instant petition is accordingly disposed of.
