Applicants/accused
Muhammad Asif son
of Mustaqeem Khan and Ameer Ali son of Muhammad Nawab, seek
protective bail in FIR No.449/2022, registered
at P.S. Bilal Colony, District Central Karachi, for offences under sections
365-A/34, PPC read with Section 7 of the Anti-Terrorism Act, 1997. It is inter alia contended that applicants/accused
have been shown as absconder in the final report and NBW has been issued
against them by learned Anti-Terrorism Court-XV, Karachi. It is further
contended that the applicants/accused are prepared to surrender before the
trial Court but they apprehend arrest at the hands of police under the
influence of complainant for mala fide reasons.
Since the applicants/accused wish to surrender before the
trial Court, without touching the merits of the case, protective bail is granted to applicants/accused Muhammad Asif son
of Mustaqeem Khan and Ameer Ali son of Muhammad Nawab, for a period
of seven (07) days from today,
subject to furnishing solvent surety in the sum of Rs.50,000/- (Rupees Fifty thousand) each
and P.R bond in the like amount to the satisfaction of the Nazir of this Court.
Operation of NBW issued against the applicants/accused by the trial Court is
suspended for seven days. Applicants/accused are directed
to surrender before the trial Court concerned in the aforesaid period. This
order shall cease to have its effect after expiry of seven days from today or
whenever the applicants/accused surrender before the trial Court, which one
occurs earlier. It is made clear, in case, applicants/accused fail to surrender
before the trial Court in the aforesaid period, their bail bond shall stands
automatically forfeited.
The instant
criminal bail application is accordingly disposed
of.
