Syed Masood Hussain Shah son of Syed Iqbal
Hussain Shah, through his attorney Wasib Ali son of Ameer Hamzo has filed this constitution petition under Article
199 of the Constitution of Islamic Republic of Pakistan, 1973 against the
respondents, and seeks protective/transitory bail in Call-up Notice dated
14.05.2024 under Section 19 of the National Accountability Ordinance, 1999
regarding investigation against the officer and officials of LDA, NESPAK and
others. It is stated that petitioner/accused is at UK,
he is prepared to join the investigation and surrender before the trial Court but
apprehends his arrest at the hands of NAB officials for mala fide reasons.
Since petitioner/accused
Syed Masood Hussain Shah son of Syed Iqbal
Hussain Shah is
prepared to surrender before the trial Court, without touching the merits of
the case, protective/transitory bail is granted to him for a period of ten (10) days from today, subject to
furnishing solvent surety in the sum of Rs.100,000/- (Rupees One
Hundred Thousand) and P.R bond in the like amount to the satisfaction of
the Nazir of this Court. Petitioner is directed to surrender before the trial
Court in the aforesaid period. Petitioner/accused is further directed to join
the investigation. This order shall cease to have its effect after expiry of ten
days from today or whenever the petitioner/accused surrenders before trial Court,
which one occurs earlier. In case, petitioner fails to surrender before the trial
Court within the aforesaid period, his bail bond shall stand automatically forfeited.
Let the copy of this order be sent to the Secretary, Ministry of Interior,
Government of Pakistan, Islamabad, by fax for information.
The instant petition is accordingly disposed of.
