Applicants/accused Rehm Ali,
Sahib Khan, Wishal and Janan
have filed post arrest bail applications in FIR No. 442/2023 for offences under
Sections 147/148/149/186/353/324/302 PPC read with Section 7 of ATA 1997
registered at P.S Surjani Town, Karachi. Prior to
this, applicants/accused applied for post arrest bail before learned Judge,
ATC-V at Karachi, but the same were rejected vide order dated 02.08.2023. Learned
advocate for the applicants/accused after arguing the bail applications at some
length, does not press the same and submits that now fresh ground is available
to the applicants/accused as challan has been submitted
before the trial Court. Addl. P.G submits that bail applications were dismissed
mainly on the ground that case was under investigation, now final report has
been submitted before the trial Court.
Since
bail applications are not pressed, the same are dismissed as not pressed. However,
applicants/accused would be at liberty to repeat bail applications before the
trial Court. In case bail applications are filed before the trial Court, the
same shall be decided after hearing the parties, within 10 days, in accordance
with law.
