Learned advocate for the
applicant/accused pointed out that bail application has not been decided by the
trial Court on merits as police papers were not available before the trial
court on 29.02.2024, the date on which bail application was dismissed. It is
stated that now police papers are available before the trial Court. Counsel for
the applicant/accused submits that he would not press the bail application and
would approach the trial Court in the first instance.
Addl. P.G recorded no objection.
In the view of above, bail
application is dismissed as not pressed. However, counsel for the
applicant/accused would be at liberty to repeat bail application before the
trial Court, the same shall be decided by the trial Court on merits within 15
days under intimation to this court.
