            Through this constitution petition, petitioner Kamran Bashir nominated as an accused in FIR No. 320/2016 registered at P.S FIA, AHT Circle, Karachi for offences under Sections 17(2)(b)/18(a) & 22(b) Emigration Ordinance, 1979, seeks protective/transitory bail. This petition is filed on his behalf by his mother namely Gul Yasmeen wd/o Malik Muhammad Bashir Nashad. It is stated that at present petitioner/accused is at Malaysia and his ticket through Qatar Airways has been confirmed to land at Karachi on Monday, 23rd March 2023. It is submitted that petitioner/accused is prepared to surrender before learned Special Judge (Central)-II, Karachi in the aforesaid crime but apprehends his arrest at Jinnah International Airport, Karachi at the hands of FIA for the malafide reasons. As regards maintainability of the petition, reliance has been placed upon the orders passed by this Court in C.P.No.D-7171 of 2021 dated 21.12.2021.

In the above stated circumstances, petitioner/accused Kamran Bashir is granted protective-cum-transitory bail for a period of 10 (ten) days from today subject to furnishing solvent surety in the sum of Rs.100,000/- (Rupees One Lac Only) and P.R bond in the like             amount to the satisfaction of Nazir of this Court. We hereby direct NADRA to unblock CNIC of the petitioner Kamran Bashir son of           Malik Muhammad Bashir Nashad, so that he may obtain temporary      travel documents to travel to Pakistan after obtaining his travel    documents and to surrender himself before the concerned trial Court at Karachi in the aforesaid crime. This order shall cease to have its effect after expiry of (10) days from today or when the petitioner/accused surrenders before the concerned trial court, which one occurs earlier. In case, the petitioner/accused fails to surrender before the learned trial Court within the aforesaid period, his bail bond shall stand forfeited.

Let copy of the order be sent to the Director NADRA, Government of Pakistan for compliance.

Instant petition is accordingly disposed of.
