            This constitution petition under Article 199 of the Constitution of Islamic Republic of Pakistan, 1973, is filed on behalf of petitioners/accused Muddasir Masood son of Masood Ahmed Khan and Faiza Muddasir wife Muddasir Masood, through their attorney Masood Ahmed Khan son of Riaz Ahmed Khan, for seeking protective/transitory bail in FIR No.401/2023, registered at P.S. Defence, Karachi South for offence under Section 489-F, PPC. It is inter alia contended that at present petitioners/accused are at Dubai, and they are prepared to surrender before the trial Court but apprehend arrest at the hands of police/FIA officials while approaching the trial Court. It is further submitted that petitioners/accused shall arrive at JIAP Karachi on 05.09.2024.

 

 

            Since petitioners/accused Muddasir Masood son of Masood Ahmed Khan and Faiza Muddasir wife Muddasir Masood are prepared to surrender before the trial Court, without touching the merits of the case, protective/transitory bail is granted to them for a period of seven (7) days from today, subject to their furnishing solvent surety in the sum of Rs.50,000/- (Rupees Fifty Thousand) each and P.R bond in the like amount to the satisfaction of the Nazir of this Court. Petitioners are directed to surrender before the trial Court concerned in the aforesaid period. Operation of NBW issued against the petitioners/accused, if any, is suspended for seven days. This order shall cease to have its effect after expiry of seven days from today or whenever the petitioners/accused surrender before the trial court, which one occurs earlier. In case, petitioners fail to surrender before the trial Court within the aforesaid period, their bail bond shall stand automatically forfeited. Let the copy of this order be sent to the Secretary, Ministry of Interior, Government of Pakistan, Islamabad, by fax for information.

           

            The instant petition is accordingly disposed of.
