            This Constitution Petition is filed by Mst. Urooj Zehra Zaidi daughter of Syed Ali Gohar Zaidi through her Attorney, who is presently at Dubai, seeks removal of her name from ECL and recalling of red warrants issued against her in order to enable her to appear before learned trial Court.

Notices of this petition were issued to the respondents as well as DAG. During course of arguments, learned counsel for the petitioner pointed out that yet case/FIR No. 16/2010 registered at PS FIA CBC Karachi under Section 411/420/468/471/109 PPC is pending before Special Court (Offence in Banks) Sindh at Karachi and NBWs have been issued against her.

After arguing the petition at some length, counsel for the petitioner prayed that this petition may be converted to the protective bail. DAG recorded no objection. Order accordingly. Office to assign the number.

Without touching merits of the case, applicant/accused Mst. Urooj Zehra Zaidi is granted protective/transitory bail for a period of fifteen (15) days from today, subject to her furnishing solvent surety in the sum of Rs.100,000/- (Rupees One Lac Only) and P.R. bond in the like amount to the satisfaction of the Nazir of this Court. In the meanwhile operation of red warrants/NBWs issued against the applicant/accused is suspended for 15 days. Ministry of Interior, Government of Pakistan, is directed to lift the name of the petitioner for 02 weeks. Applicant/accused Mst. Urooj Zehra Zaidi shall not be arrested by the FIA officials at Airport because she is prepared to surrender before the trial Court and face trial. Passport of the applicant/accused Mst. Urooj Zehra Zaidi shall also be renewed as per rules, for the limited purpose. Applicant/accused is directed to surrender before the concerned trial Court in the aforesaid crime/case. This order shall cease to have its effect after expiry of (15) days from today or when the applicant/accused surrenders before the concerned trial Court which one occurs earlier. It is made clear that in case applicant/accused fails to surrender before the concerned trial Court within the aforesaid period her bail bond shall stand forfeited autometically.  

 

            Application is accordingly disposed of.
