This
constitution petition under Article 199 of the Constitution of Islamic Republic
of Pakistan, 1973, is filed on behalf of petitioner/accused Muddasir Masood son of Masood
Ahmed Khan, through his attorney/father Masood Ahmed
Khan, for seeking protective/transitory bail in FIR No.30/2024, registered at P.S. Moro for offences under Section
489-F, 420, 406, PPC. It is inter alia
contended that at present petitioner/accused is at Dubai, and he is prepared to
surrender before the trial Court but he apprehends his arrest at the hands of police/FIA
officials while approaching the trial Court. It is further submitted that
petitioner/accused shall arrive at JIAP Karachi on 05.09.2024.
Since petitioner/accused
Muddasir Masood son
of Masood Ahmed Khan is prepared to surrender before the trial Court, without touching
the merits of the case, protective/transitory bail is granted to him for a
period of seven (7) days from today,
subject to furnishing solvent surety in the sum of Rs.50,000/- (Rupees Fifty Thousand) and P.R bond in the like amount to the
satisfaction of the Nazir of this Court. Petitioner is directed to surrender
before the trial Court concerned in the aforesaid period. Operation of NBW
issued against the petitioner/accused, if any, is suspended for seven days. This
order shall cease to have its effect after expiry of seven days from today or
whenever the petitioner/accused surrenders before the trial court, which one
occurs earlier. In case, petitioner fails to surrender before the trial Court
within the aforesaid period, his bail bond shall stand automatically forfeited.
Let the copy of this order be sent to the Secretary, Ministry of Interior,
Government of Pakistan, Islamabad, by fax for information.
The instant petition is accordingly disposed of.
