            Applicants/accused Mushtaq Ahmed son of Nazeer Hussain, Ashfaq son of Nazeer Hussain and Matloob Hussain son of Abdul Ghafoor seek protective bail in FIR No.1223/2024, registered at P.S. KIA, Korangi Karachi for offence under Sections 385, 386, 34, PPC read with Section 7 of Anti-Terrorism Act, 1997. It is inter alia contended that applicants/accused are prepared to surrender before trial Court but apprehend their arrest at the hands of police under the influence of complainant. Serious mala fide has been alleged against the complainant as well as police officials.

 

Without touching the merits of the case, protective bail is granted to applicants/accused Mushtaq Ahmed son of Nazeer Hussain, Ashfaq son of Nazeer Hussain and Matloob Hussain son of Abdul Ghafoor for a period of five (05) days from today, subject to furnishing solvent surety in the sum of Rs.40,000/- (Rupees Forty thousand) each and P.R bond in the like amount to the satisfaction of the Nazir of this Court. Applicants/accused are directed to surrender before learned Administrative Judge, Anti-Terrorism Courts, Karachi Division in the aforesaid period and join the investigation forthwith. This order shall cease to have its effect after expiry of five days from today or whenever applicants/accused surrender before learned Administrative Judge, Anti-Terrorism Courts, Karachi, which one occurs earlier. It is made clear, in case, applicants/accused fail to surrender before learned Administrative Judge, ATCs Karachi in the aforesaid period, their bail bond shall stands automatically forfeited.

 

            The instant criminal bail application is accordingly disposed of.
