          At the outset counsel for the petitioner states that he has no instructions from the petitioner nor from the surety and that though he has tried to contact them but has not been able to locate them. He further states that through order dated 28.5.2009 protective bail to the petitioner was granted for a period of ten days i.e. uptil 08.6.2009 on his furnishing surety of Rs. 5,00,000/- (Rupees five lac only)  and P.R.Bond in the like amount and that such protective bail order has lapsed long ago and he has no information as to whether petitioner has surrendered himself before the trial court or not. He pleads no instructions.

The petitioner is not in attendance and it also appears that protective bail order has also lapsed. In the circumstances, petition is liable to be dismissed on the sole ground that petitioner is not in attendance and further the counsel for the petitioner pleads no instructions and additionally that the order granting protective bail has lapsed. The petition is, therefore, dismissed.

Let a report from the trial court be called within two weeks as to whether the petitioner has surrendered himself before it or not. In case petitioner has not surrendered himself to the trial court, further proceedings regarding forfeiture of surety amount will be initiated against the surety.
