In this Constitution Petition, the
main grievance of the petitioner is against the excess committed by police
officials/respondents. Being relevant Section 22-A(6)
of Cr.P.C, is reproduced as under:
22-A(6) An ex
officio Justice of Peace may issue appropriate directions to the police
authorities concerned on a complaint regarding:
(i) non-registration of criminal case;
(ii)
transfer of
investigation from one police officer to another;
(iii)
neglect, failure or excess committed by a police authority in
relation to its functions and duties.
Alternate remedy is already
available to the petitioner to approach concerned Sessions Judge/Ex-Officio
Justice of Peace as provided under section 22-A(6)
Cr.P.C.
In the view of above, counsel
for the petitioner does not press the petitioner anymore and submits that he
would approach concerned Sessions Judge/Ex-Officio Justice of Peace. The
petition is dismissed as not pressed.
