            Petitioner/accused Mirza Abdul Basit Baig son of Mirza Badar Baig, who is presently residing at UAE has filed this constitution petition under Article 199 of the Constitution of Islamic Republic of Pakistan, 1973, for protective/transitory bail, through his attorney/mother, namely, Mst. Yasmeen Begum wife of Mirza Badar Baig, in Crime No.7/2022, registered at P.S. Methadar, Karachi South for offence under section 408, 420, 34, PPC. It is inter alia contended by the counsel for petitioner that petitioner intends to surrender before the trail Court but he apprehends his arrest as the trial Court has issued NBW against him. Serious mala fide on the part of complainant and police has been alleged.  

 

            Since petitioner/accused Mirza Abdul Basit Baig son of Mirza Badar Baig is prepared to surrender before the trial Court, without touching the merits of the case, protective/transitory bail is granted to him for a period of Seven (7) days from today, subject to furnishing solvent surety in the sum of Rs.60,000/- (Rupees Sixty Thousand) and P.R bond in the like amount to the satisfaction of the Nazir of this Court. Petitioner/accused is directed to surrender before the trial Court in the aforesaid period. Operation of NBW issued against the petitioner is suspended for seven days. This order shall cease to have its effect after expiry of seven days from today or whenever the petitioner/accused surrenders before the trial Court, which one occurs earlier. In case, petitioner fails to surrender before the trial Court within the aforesaid period, his bail bond shall stand automatically forfeited. Let the copy of this order be sent to the Secretary, Ministry of Interior, Government of Pakistan, Islamabad, by fax for information.

           

            The instant petition is accordingly disposed of.
