This is second bail application. 1st
bail application No. 575/2023 was dismissed by this Court vide order dated
16.11.2023 with direction to the trial Court to conclude the trial within 02
months under intimation to this Court. Thereafter, bail application was
repeated before the trial Court and learned Judge,
ATC-XII, Karachi vide order dated 21.03.2024 dismissed the bail application.
Applicant/accused approached this Court. Report was called from the trial
Court. Report dated 30.04.2024 is received which shows that substantial
progress has been made. However, counsel for the applicant/accused submits that
learned Judge, ATC-XII, Karachi has been transferred and at present Court is
lying vacant. Counsel for the applicant/accused submits that he would be
satisfied and would not press the bail application, if case is withdrawn from
the Court which is lying vacant and it is made over to
another Court for expeditious disposal.
Addl. P.G has also been heard.
Bail Application is dismissed as not
pressed. However, case is withdrawn from the Anti-Terrorism Court-XII, Karachi
and it is made over/transferred to learned Administrative Judge, ATCs Karachi
to try the case himself or transfer it to some other Anti-Terrorism Court for
its disposal within two months under intimation to this Court. Let copy of the
order be sent by fax to learned Administrative Judge,
ATCs Karachi for compliance. However, applicant/accused would be at liberty to
repeat bail application before trial Court, in case trial is not concluded
despite directions of this Court.
