Muhammad Bakhsh son of Shah Bakhsh, seeks protective bail in Crime No. 24/2023
registered at PS FIA, Crime & AHT Circle, Sukkur for offence under Sections
409, 420, 109 PPC read with Section 5(2) PCA-II of 1947. It
is inter alia contended that name of
the applicant/accused is not appearing in the FIR but his name is appearing in
the interim challan. He further contended that applicant/accused is prepared to
surrender before trial Court, but apprehends his arrest at the hands of FIA
officials for the malafide reasons. Serious malafide against the FIA officials is
alleged.
Without touching the merits of the
case, protective bail for a period
of five (5) days from today is granted to applicant/accused Muhammad Bakhsh son of Shah Bakhsh,
subject to furnishing solvent surety in the sum of Rs.30,000/- (Rupees Thirty
Thousand Only) and P.R. bond in the like amount to the satisfaction of the
Nazir of this Court. Applicant/accused is directed to surrender before the concerned
trial Court in the aforesaid crime. This order shall cease to have its effect
after expiry of five days from today
or when the applicant/accused surrenders before the concerned trial Court which
one occurs earlier. It is made clear that in case applicant/accused fails to
surrender before the concerned trial Court within the aforesaid period his bail
bond shall stand forfeited.
Application
is accordingly disposed of.
