Learned advocate for the
applicant/accused pointed out that ATC-XII, Karachi is lying vacant since long;
charge has already been framed and case is fixed for trial. To avoid delay in
disposal of the case and keeping in view the provisions of Anti-Terrorism Act
1997, Special Case No. 91 of 2023 pending before ATC-XII is withdrawn. Learned
Administrative Judge ATCs is directed to try the case himself or make it over
to some other Anti-Terrorism Court with direction to the presiding officer to
decide the case within 03 months.
In the view of above, counsel for
the applicant/accused does not press this bail application, the same is
dismissed as not pressed. Let copy of the order be
sent to learned Administrative Judge, ATCs, Karachi for compliance.
