Counsel for the
applicants/accused does not press instant application for protective bail to
the extent of applicant/accused Jalal Khan, to that extent, the instant bail
application is dismissed as not pressed. However, applicants/accused Akber
Khan, Muhammad Sharif and Mehrab Ali seek protective bail in Crime No.38/2024
registered at P.S Rahuki, Hyderabad for offences punishable under Sections 324,
353, 114, 147, 148, 149, 337A(i), 427, 337F(i), 504 PPC read with section 7 of
ATA 1997. It is inter-alia contended that applicants/accused are
prepared to surrender before trial court at District Hyderabad, but apprehend their
arrest at the hands of the police of PS Rahuki, Hyderabad, for malafide
reasons.
Without touching the merits of the
case, protective bail for a period
of five (05) days from today is granted to applicants/accused Akber Khan son of Kazam Khan, Muhammad Sharif son of
Pandhi and Mehrab Ali son of Jalaluddin, subject to their furnishing
solvent surety in the sum of Rs.50,000/- (Rupees fifty
thousand Only) each and P.R. bond in
the like amount to the satisfaction of the Nazir of this Court. Applicants/accused
are directed to surrender before the concerned trial
Court in the aforesaid crime and join investigation forthwith. This order shall
cease to have its effect after expiry of five
days from today or when the applicants/accused surrender before the concerned
trial Court which one occurs earlier. It is made clear that in case applicants/accused
fail to surrender before the concerned trial Court within the aforesaid period their
bail bonds shall stand forfeited.
