Applicant/accused
Muhammad Hamid alias Pita son of Munshi Khan is
present along with his counsel. He seeks protective bail in FIR No.159/2013, registered at P.S. Shah
Faisal Colony, for offence under section 302, 34, PPC. It is inter alia contended that challan has been submitted against applicant/accused and he
had no knowledge regarding registration of FIR and submission of challan against him. It is submitted that NBW has been
issued against the applicant/accused, he is prepared
to surrender before the trial Court. Serious mala fides on the part of the
police as well as complainant have been alleged.
Without touching the merits of the case, protective bail is granted to
applicant/accused Muhammad Hamid alias
Pita son of Munshi Khan for a period of four (04) days from today, subject to
furnishing solvent surety in the sum of Rs.50,000/- (Rupees Fifty Thousand)
and P.R bond in the like amount to the satisfaction of the Nazir of this Court.
Operation of NBW issued against the applicant/accused is suspended for four
days. Applicant/accused is directed to surrender before the trial Court in the
aforesaid period. This order shall cease to have its effect after expiry of four
days from today or whenever the applicant/accused surrenders before the trial
Court, which one occurs earlier. It is made clear, in case, applicant/accused
fails to surrender before the trial Court in the aforesaid period, their bail
bond shall stands automatically forfeited.
The instant
criminal bail application is accordingly disposed
of.
