            Applicant/accused Muhammad Ikram Gul son of Gul Muhammad is present along with his counsel. This is second protective bail application moved by applicant/accused. He seeks protective bail in FIR No.263/2024, registered at P.S. Tipu Sultan, Karachi for offence under section 489-F, PPC. It is inter alia contended by the counsel for the applicant/accused that prior to this protective bail for 8 days was granted by this Court to the applicant/accused vide order dated 13.11.2024 in the aforesaid FIR and he surrendered before the trial Court but ad-interim bail granted to the applicant/accused was recalled on 28.11.2024 by learned VIII Additional Sessions Judge, Karachi South due to absence of applicant/accused. It is further contended that absence of the applicant/accused before learned Additional Sessions Judge-VIII, Karachi South was neither deliberate nor intentional but beyond his control. Serious mala fide on the part of the police and complainant has been alleged.

 

Mr. Muhammad Asif Malik, advocate, filed power on behalf of the complainant, it is taken on record.

 

Without touching the merits of the case, protective bail is granted to applicant/accused Muhammad Ikram Gul son of Gul Muhammad for a period of four (04) days from today, subject to furnishing solvent surety in the sum of Rs.50,000/- (Rupees Fifty Thousand) and P.R bond in the like amount to the satisfaction of the Nazir of this Court. Applicant/accused is directed to surrender before the trial Court in the aforesaid period. This order shall cease to have its effect after expiry of four days from today or whenever the applicant/accused surrenders before the trial Court, which one occurs earlier. It is made clear, in case, applicant/accused fails to surrender before the trial Court in the aforesaid period, their bail bond shall stands automatically forfeited.

 

            The instant criminal bail application is accordingly disposed of.
