Learned advocate for the
applicants/accused, after arguing the bail application at some length, pointed
out that trial Court is lying vacant and he would be satisfied if case is
transferred to some other Anti-Terrorism Court with direction to decide the
case expeditiously. Addl. P.G recorded no objection.
In the view of above, Special Case
No. 05/2021 (FIR No. 272/2009 for offence punishable under sections 353, 324,
186, 34 PPC, 3/4 Explosive Substance Act read with Section 7 of ATA 1997
registered at P.S Baghdadi, Karachi) is withdrawn from the file of Anti-Terrorism
Court No. IV, Karachi and it is made-over to learned Administrative Judge, ATCs
Karachi to assign it to some other Anti-Terrorism Court. Concerned Judge ATC
shall decide the case within 03 months.
In the view of above, bail
application is dismissed as not pressed. Let copy of the order be sent to learned Administrative Judge, ATCs Karachi.
