Petitioner Muhammad Zeeshan Arif has filed instant Constitution
Petition under Article 199 of the Constitution 1973 against the respondents and
he has prayed for the following reliefs:
“It is therefore, prayed that this Hon’ble
Court may be pleased to direct the Respondents and their other officers not to
harass, tease, pressurize and black mail the petitioner at the behest of
private respondent No.4 by forcing the petitioner to pay huge money or
otherwise for false involvement of the petitioner in false Cyber Crime cases;
To provide legal protection to the petitioner.”
2. Notices
were issued against the respondents as well as DAG. Mr. Muhammad Ajmal Solangi advocated filed
power on behalf of the respondent No.4. Inquiry Officer filed comments on
behalf of respondents No. 1 to 3, in which it is mentioned that prior to this
petition, the petitioner has also filed direct complaint before 1st
Judicial Magistrate, Karachi East against Inquiry Officer and complainant,
which is subjudice before that Court and the
petitioner has approached this Court with unclean hands.
3. Article
199 of the Constitution of 1973 can only be invoked when no other adequate
remedy is provided by law, but in the instant case, petitioner has already filed
direct complaint on same subject matter. This fact has not been denied by the
counsel for the petitioner.
4. In
the view of the comments filed by the Inquiry Officer, counsel for the
petitioner does not press this petition anymore, the
same is dismissed as not pressed.
