Applicant/accused Noor Hakeem seeks
protective bail in Crime No.539/2023 registered at PS Docks for offences under
sections 353, 324, 427, 34 PPC read with Section 7 of ATA 1997. It is submitted
that NBWs have been issued against the applicant/accused by Judge,
Anti-Terrorism Court No.I, Karachi. It is further
submitted that applicant/accused is prepared to surrender before trial court
but apprehends his arrest as NBWs have been issued against him. Serious
malafide on the part of police has been alleged.
Without touching merits of the case, applicant/accused
Noor Hakeem is granted protective bail
for a period of four (04) days from
today, subject to his furnishing solvent surety in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) and P.R. bond in the
like amount to the satisfaction of the Nazir of this Court. In the meanwhile operation of NBWs issued against the applicant/accused
is suspended for 04 days. Applicant/accused is directed to surrender before the
concerned trial Court in the aforesaid crime/case. This order shall cease to
have its effect after expiry of (04)
days from today or when the applicant/accused surrenders before the
concerned trial Court, which one occurs earlier. It is made clear that in case applicant/accused
fails to surrender before the concerned trial Court within the aforesaid period
his bail bond shall stand forfeited automatically.
Instant bail application is accordingly
disposed of.
