            Applicant/accused Haseeb son of Kareem seeks post-arrest bail in Crime No.387/2024, registered at P.S. Pak Colony, for offence under section 23(1)(a) of the Sindh Arms Act, 2013. Prior to this, applicant/accused applied for the same relief before learned Additional District & Sessions Judge-II, Karachi West, the same was rejected vide order dated 23.08.2024. Thereafter, applicant/accused has approached this Court. Learned advocate for applicant/accused mainly contended that accused Haseeb has been granted bail in main case bearing Crime No.383/2024, registered at P.S. Pak Colony, for offence under section 6/9-2(2) of the Control of Narcotic Substances Act, 1997 by learned Civil Judge/Judicial Magistrate, Karachi West, vide order dated 05.09.2024. It is further submitted that investigation is complete and the accused is no more required for investigation. Learned Additional Prosecutor General Sindh opposed the bail application on the ground that case is fresh.

 

            I am inclined to grant bail to applicant/accused Haseeb for the reasons that the applicant/accused has been granted bail in the main case by trial Court vide order dated 05.09.2024 and this is off-shoot; investigation is complete and the applicant/accused is in custody; all the PWs are police officials, there is no question of tempering with the evidence. In these circumstances, applicant/accused is extended the concession of bail. Resultantly, bail is granted to applicant/accused   Hasaeeb son of Kareem, subject to the furnishing solvent surety in the sum of Rs.50,000/- (Rupees fifty thousand) and P.R. bond in the like amount to the satisfaction of the trial Court.

 

            Instant bail application is accordingly disposed of.
