Through this Criminal Revision
Application, applicant/accused Muhammad Waseem Shaikh has called in question
order dated 02.12.2024 passed by learned V-Additional Sessions Judge, Karachi
Central in Illegal Dispossession Application No. 11 of 2024, whereby an
application under Section 265-K Cr.P.C moved by the applicant/accused was
dismissed.
2. Notices of this application was issued to the other side.
3. Applicant/accused submits that he would
not press this Crl. Revision Application, if the case is transferred from
learned V-Additional Sessions Judge, Karachi Central to some other Court for
expeditious disposal. Applicant/accused contended that a fair trial is not being
conducted but allegation has not been substantiated by material.
4. Counsel appearing for the complainant
as well as DPG pointed out that trial Court had also made reference to learned
Sessions Judge concerned for transfer of case to some other court.
5. In the view of above, Revision is
dismissed as not pressed. However, by consent Illegal Dispossession Application
No. 11 of 2024 is withdrawn from the file of learned V-Additional Sessions
Judge, Karachi Central, it will be heard by Sessions Judge himself or he will
assign the same to some other Additional Sessions Judge having jurisdiction in
the matter for expeditious disposal in accordance with law. Let the copy of the
order be sent to learned V-Additional Sessions Judge,
Karachi Central through learned Sessions Judge concerned.
6. In the view of above, applicant/accused
does not press instant Crl. Revision Application, the
same is dismissed as not pressed.
