Applicant/accused
Amir Khan son of Kabeer Khan
is present along with his counsel. He seeks protective bail in FIR No.431/2024, registered at P.S. Ferozabad, Karachi East, for offence under sections 397, 34
PPC. It is inter alia contended that applicant/accused
is innocent and he has been falsely implicated in this case; he had no
knowledge regarding pendency of case against him, when he came to know
regarding registration of aforesaid FIR, he prepared to surrender before the
trial Court but he apprehends his arrest as NBW has been issued against him. Serious
mala fides on the part of police and complainant have been alleged.
Without touching the merits of the case, protective bail is granted to
applicant/accused Amir Khan son of Kabeer
Khan, for a period of four (4) days
from today, subject to furnishing solvent surety in the sum of Rs.50,000/- (Rupees fifty thousand) and P.R bond in the like amount to the
satisfaction of the Nazir of this Court. Operation of NBW issued against the
applicant/accused is suspended for four days. Applicant/accused is directed to
surrender before the trial Court in the aforesaid period. This order shall
cease to have its effect after expiry of four days from today or whenever applicant/accused
surrenders before the trial Court, which one occurs earlier. It is made clear,
in case, applicant/accused fails to surrender before the trial Court in the
aforesaid period, his bail bond shall stands automatically forfeited.
The instant
criminal bail application is accordingly disposed
of.
