            It appears that application for protective bail was moved on behalf of applicant/accused Nayyar-ul-Haq son of Ahsan-ul-Haq in FIR No.85/2024, registered at P.S. Sahil, Karachi for offence under section 302/342/34, PPC on 03.09.2024. This Court on the said date observed that there is issue of jurisdiction, yet forum was not decided and it was ordered that no coercive measures including arrest shall be made in respect of applicant/accused. Additional Prosecutor General Sindh pointed out that there is development in the case, challan has been submitted and Additional Sessions Judge-IV, Judicial Complex, South Karachi, has taken cognizance of offence under Section 302, PPC against the applicant/accused.

 

            In the view of above, order dated 03.09.2024 is modified. Without touching the merits of the case, protective bail is granted to applicant/accused Nayyar-ul-Haq son of Ahsan-ul-Haq in the aforesaid FIR, for a period of nine (9) days from today, subject to furnishing solvent surety in the sum of Rs.50,000/- (Rupees fifty thousand) and P.R bond in the like amount to the satisfaction of the Nazir of this Court. Applicant/accused is directed to surrender before the trial Court in the aforesaid period. This order shall cease to have its effect after expiry of nine days from today or whenever the applicant/accused surrenders before the trial Court, which one occurs earlier. It is made clear, in case, applicant/accused fails to surrender before the trial Court in the aforesaid period, their bail bond shall stands automatically forfeited.

 

            The instant criminal bail application is accordingly disposed of.
