Applicant/accused
Solat Abbas son of Nasir
Abbas, is present along with his counsel. He seeks protective bail in FIR No.33/2022, registered at P.S. Anti-Encroachment
Force Zone-I, Karachi for offence under
section 8(I) of the SPP (ROE) Act, 2010. It is inter alia contended that applicant is innocent and the complainant
has lodged false FIR against the applicant/accused for mala fide reasons.
Applicant/accused is prepared to surrender before the trial Court but
apprehends his arrest Serious mala fides on the part of complainant and police
have been alleged.
Without touching the merits of the case, protective bail is granted to
applicant/accused Solat Abbas son of Nasir
Abbas, for a period of five (5) days
from today, subject to furnishing solvent surety in the sum of Rs.50,000/- (Rupees fifty thousand) and P.R bond in the like amount to the
satisfaction of the Nazir of this Court. Operation of NBW issued against the
applicant/accused is suspended for four days. Applicant/accused is directed to
surrender before the trial Court in the aforesaid period. This order shall
cease to have its effect after expiry of four days from today or whenever the applicant/accused
surrenders before the trial Court, which one occurs earlier. It is made clear,
in case, applicant/accused fails to surrender before the trial Court in the
aforesaid period, his bail bond shall stands automatically forfeited.
The instant
criminal bail application is accordingly disposed
of.
