Learned
advocate for applicant/accused Muhammad Khan does not press the instant
criminal bail application for post arrest bail, however, submits that the trial
Court may be directed to decide the case expeditiously. Learned Additional
Prosecutor General as well as counsel for complainant recorded no objection for
such directions. However, it appears that this Court called report from the
trial Court, which reflects that prosecution has failed to produce witnesses
before the trial Court.
Instant
criminal bail application is dismissed as not pressed,
however, trial Court is directed to decide the case within three months, under
intimation to this Court through learned MIT-II. SSP concerned is directed to
ensure the production of prosecution witnesses before the trial Court. Let the
copy of this order be sent to the SSP concerned by fax for compliance.
