It is, inter alia, contended by the learned counsel for the petitioner that NAB Reference No. 10 of 2005 was filed against the present petitioner in the Accountability Court at Karachi and petitioner approached this Court for grant of bail by way of Constitutional Petition No. D-663/2005 which was granted to the petitioner vide order dated 27.6.2005. Learned counsel states that on the promulgation of NRO, the case against the petitioner was terminated vide order dated 28.1.2009 and now in view of the order of Hon’ble Supreme Court dated 16.12.2009 the Reference against the petitioner has been reactivated and there is an apprehension of the petitioner being arrested. Petitioner’s counsel requests that pre-arrest bail may be granted to the petitioner.

Without touching the merits of the case, the petitioner is granted interim pre arrest bail on his furnishing surety in the sum of Rs. 5,00,000/- (Rupees five lac only) and P.R.Bond in the like amount to the satisfaction of the Nazir of this Court.

Issue notice to respondents as well as D.P.G.NAB for next date. To come up on 07.01.2010 for confirmation or otherwise.
