            Mr. Abdul Qudus Jatoi, advocate a/w applicant Taj Muhammad

            Applicant/accused Taj Muhammad son of Abdul Sattar seeks protective bail in F.I.R. No.02/2019, registered at P.S. CTD Sukkur, for offences under sections 11-F(6) of Anti-Terrorism Act, 1997.

 

            It is inter alia contended that accused Mushtaq Ahmed and others have already been acquitted by learned Judge, Anti-Terrorism Court-II, Karachi vide judgment dated 30.05.2020 in Special Case No.10 of 2019 for offences under sections 11-F(6) of Anti-Terrorism Act, 1997. It is submitted that applicant/accused is prepared to surrender before the trial Court but apprehends his arrest with ulterior motive at the hands of CTD police on the way to the trial Court as NBW has been issued against him. Serious mala fide on the part of CTD police is alleged. It is further submitted that as the applicant had life threat, he jumped the bail.

 

            Without touching the merits of the case, protective bail for a period of three (3) days from today is granted to applicant/accused Taj Muhammad son of Abdul Sattar, subject to his furnishing solvent surety in the sum of Rs.100,000/- (Rupees One Hundred Thousand) and P.R. bond in the like amount to the satisfaction of the Nazir of this Court. Operation of NWBs issued against the applicant/accused is suspended for three (3) days. Applicant/accused is directed to surrender before the trial Court in the aforesaid crime. This order shall cease to have its effect after expiry of three days from today or when the applicant/accused surrenders before the trial Court, which one occurs earlier. It is made clear that in case applicant/accused failed to surrender before the trial Court within the aforesaid period his bail bond shall stand forfeited.   

 

            Application is accordingly disposed of.
