Learned counsel for the petitioner contends that petitioner was implicated in NAB Reference No. 01/2001, from which he was acquitted on 03.4.2008 under the NRO and that earlier through judgment dated 07.10.2005 of Accountability Court-IV Sindh, Karachi co-accused Khawaja Qadeer Ahmed and Akhtar Hussain Askari have been acquitted. Learned counsel contends that in the face of order passed by Hon’ble Supreme Court on 16.12.2009 the proceeding before the Accountability Court is going to revive against the petitioner and petitioner apprehends taking of coercive measures that of his arrest and states that such an act will not only be malafide on the part of prosecution but is likely to cause harassment, irreparable loss and humiliation to the petitioner. Petitioner’s counsel requests that pre-arrest bail may be granted to the petitioner.

Without touching the merits of the case, the petitioner is granted interim pre-arrest bail on his furnishing surety in the sum of Rs. 10,00,000/- (Rupees one million only) and P.R.Bond in the like amount to the satisfaction of the Nazir of this Court.

Issue notice to D.P.G.NAB for next date. To come up on 05.01.2010 for confirmation or otherwise.
