Shahnawaz son of Muhammad Ishaque
seeks protective bail in FIR No.141/2013,
registered at P.S. CID East Karachi, for offences under Sections 353, 324, 34,
PPC read with section 7 of the Anti-Terrorism Act, 1997. It is inter alia contended that presently case
is pending before learned Judge, Anti-Terrorism Court-I, Karachi and NBWs have
been issued against the applicant/accused in this case. It is further submitted
that the applicant/accused had no knowledge regarding registration of FIR and
submission of challan against him. It is further
submitted that the applicant/accused is prepared to surrender before the trial
Court but apprehends his arrest as NWB has been issued against him. Serious mala
fides on the part of police have been alleged.
Without touching the merits of the case, protective bail is granted to applicant/accused
Shahnawaz son of Muhammad Ishaque for a period of four (04) days from today, subject to his furnishing solvent surety
in the sum of Rs.50,000/-
(Rupees Fifty Thousand) and P.R
bond in the like amount to the satisfaction of the Nazir of this Court. Applicant/accused
is directed to surrender before learned Judge, Anti-Terrorism Court-I, Karachi in
the aforesaid period. Operation of NBW issued against the applicant/accused is
suspended for a period of four days from today. This order shall cease to have
its effect after expiry of four days (04) days from today or whenever the applicant/accused
surrenders before the concerned trial court, which one occurs earlier.
The instant
petition is accordingly disposed of.
