Umair Wali and Anwar
Ali, father and son, seek protective bail in FIR No.250/2023, registered at P.S. Quaidabad,
Karachi, for offences under Sections 324, 337-A(i)(ii), 337-H(ii), 383, 385,
PPC read with Section 7 of the Anti-Terrorism Act, 1997. It is submitted by the
counsel for applicants/accused that at present case is pending before learned
Judge, Anti-Terrorism Court-XIII, Karachi and NBWs have been issued against the
applicants/accused. It is inter alia contended that applicants/accused are
prepared to surrender before the trial Court but they apprehend arrest at the hands
of the police for mala fide reasons. Serious mala fide on the part of
complainant Sajjad and ulterior motive on the part of
police have been alleged.
Without touching the merits of the case, protective bail is granted to applicants/accused
Umair Wali son of Ameer Gul and Anwar Ali son of Umair Wali for a period of four
(04) days from today, subject to their furnishing solvent surety in the sum
of Rs.40,000/- (Rupees Forty Thousand) each and P.R
bond in the like amount to the satisfaction of the Nazir of this Court. Operation
of NBWs issued against the applicants/accused is suspended for four days from
today. Applicants/accused are directed to surrender
before the trial Court in the aforesaid period. This order shall cease to have
its effect after expiry of four days (04) days from today or whenever the applicants/accused
surrender before the concerned trial court, which one occurs earlier.
The instant
petition is accordingly disposed of.
