Applicant/accused Khawar son
of Muhammad Bashir seeks protective bail in FIR No.442/2023, registered at P.S. Surjani
Town, District West, Karachi, for offences under Sections 147, 148, 149, 186,
342, 353, 324, 302, PPC read with Section 7 of the Anti-Terrorism Act, 1997. It
is inter alia contended that the
applicant/accused is prepared to surrender before learned Administrative Judge,
Anti-Terrorism Courts, Karachi but it is stated that the said Court is cordoned
off by the police under the influence of the complainant. Serious mala fides on
the part of the complainant and police have been alleged.
Since the applicant/accused is prepared to surrender
before learned Administrative Judge, Anti-Terrorism Courts, Karachi, without touching
the merits of the case, protective bail
is granted to applicant/accused Khawar son of
Muhammad Bashir for a period of four (04) days from today, subject to
furnishing solvent surety in the sum of Rs.50,000/- (Rupees Fifty Thousand)
and P.R bond in the like amount to the satisfaction of the Nazir of this Court.
Applicant/accused is directed to surrender before the trial Court/learned
Administrative Judge, Anti-Terrorism Courts, Karachi in the aforesaid period. This
order shall cease to have its effect after expiry of four days from today or
whenever the applicant/accused surrenders before the trial Court, which one occurs
earlier.
The instant
criminal bail application is accordingly disposed
of.
