Petitioner/accused
Kashif Latif son of
Muhammad Latif-ur-Rehman, has filed this constitution
petition through his attorney/father Muhammad Latif-ur-Rehman,
for protective-cum-transitory bail in FIR
No.1/2024, registered at P.S. FIA, CCC, Karachi for offences under sections
23, 27 read with Section 30 of the Drug Act, 1976.
It
is inter alia contended that petitioner/accused
Kashif Latif is at UK,
aforesaid case was registered against him, he is
scheduled to land at Karachi Jinnah International Airport, Karachi on
19.02.2024 and is prepared to surrender before the trial Court concerned but
apprehends his arrest at the hands of FIA officials for mala fide reasons. A
copy of Ticket of petitioner/accused is annexed to the petition as Annexure
“A/4”, page 51.
Since the
petitioner/accused intends to face the trial and is prepared to surrender before
the trial Court concerned, without touching the merits and demerits of the
case, petitioner/accused Kashif Latif son of Muhammad Latif-ur-Rehman
is granted protective-cum-transitory
bail for a period of seven (7) days
from today, subject to furnishing solvent surety in the sum of Rs.50,000/- (Rupees Fifty Thousand) and P.R bond in
the like amount to the satisfaction of the Nazir of this Court. Petitioner/accused
is directed to surrender before the trial Court concerned in the aforesaid
period. In the meanwhile, operation of NWB issued against the
petitioner/accused is suspended. This order shall cease to have its effect
after expiry of seven (7) days from today or whenever petitioner/accused
surrenders before the trial court, which one occurs earlier. In case,
petitioner fails to surrender before the trial Court within the aforesaid
period, bail bond executed by petitioner/accused before this Court shall stand automatically
forfeited. Let the copy of this order be sent to the Secretary, Ministry of
Interior, Government of Pakistan, Islamabad, by fax for compliance.
The instant petition is disposed of in the above terms.
