Petitioner/accused
Muhammad Abbas Khan son of Muhammad Ameer Khan, has filed this constitution petition through
his attorney/friend Mohsin Bilal Malik, for protective-cum-transitory
bail in FIR No.02/2024, registered
at P.S. Cantt. Rawalpindi for
offences under sections 302, 148, 149, 109, PPC.
It
is inter alia contended that petitioner/accused
Muhammad Abbas Khan had proceeded to Saudi Arabia to perform Umrah,
aforesaid case was registered against him at P.S. Cantt.
Rawalpindi, he is scheduled to land at Karachi Jinnah International Airport,
Karachi on 17.02.2024 and is prepared to surrender before the trial Court
concerned but apprehends his arrest at the hands of police for mala fide
reasons. A copy of Ticket of petitioner/accused is produced by the counsel for
petitioner/accused.
Since the petitioner/accused
intends to face the trial and is prepared to surrender before the trial Court
concerned, without touching the merits of the case, petitioner/accused Muhammad Abbas Khan son of Muhammad Ameer Khan is granted protective-cum-transitory
bail for a period of seven (7) days
from today, subject to furnishing solvent surety in the sum of Rs.60,000/- (Rupees Sixty Thousand)
and P.R bond in the like amount to the satisfaction of the Nazir of this Court.
Petitioner/accused is directed to surrender before the trial Court concerned in
the aforesaid period. This order shall cease to have its effect after expiry of
seven (7) days from today or whenever petitioner/accused surrenders before the trial
court, which one occurs earlier. In case, petitioner fails to surrender before the
trial Court within the aforesaid period, his bail bond shall stand automatically
forfeited. Let the copy of this order be sent to the Secretary, Ministry of
Interior, Government of Pakistan, Islamabad, by fax for compliance.
The instant petition is accordingly disposed of.
