Counsel
for petitioner submits that this constitution petition may be converted to
protective-cum-transitory bail. Orders accordingly.

It
is inter alia contended that at
present petitioner/accused Imtiaz Ahmed Khan son of Mumtaz Ahmed Khan is at Saudi Arabia and he has been shown
as accused in challan submitted before the Special
Court (Offences in Banks) Sindh at Karachi in FIR No.01/2013 dated 01.02.2013,
for offences under Sections 419, 420, 468, 471, 109, PPC. It is submitted that
the petitioner/accused is prepared to surrender before the trial Court but apprehends
his arrest at the hands of FIA officials at Jinnah International Airport,
Karachi for mala fide reasons.
Since the petitioner
intends to face the trial and is prepared to surrender before the trial Court,
without touching the merits of the case, petitioner/accused Imtiaz Ahmed Khan son of Mumtaz Ahmed Khan is
granted protective-cum-transitory bail
for a period of ten (10) days from
today, subject to furnishing solvent surety in the sum of Rs.75,000/- (Rupees Seventy Five Thousand) and P.R bond in the like amount to
the satisfaction of the Nazir of this Court. Petitioner/accused is directed to
surrender before the trial Court concerned in the aforesaid period. In the
meanwhile, operation of NWB issued against the petitioner/accused is suspended.
This order shall cease to have its effect after expiry of ten (10) days from
today or whenever the petitioner/accused surrenders before the trial court,
which one occurs earlier. In case, petitioner fails to surrender before the trial
Court within the aforesaid period, his bail bond shall stand automatically forfeited.
Let the copy of this order be sent to the Ministry of Interior, Government of
Pakistan, Islamabad, by fax for compliance.
The instant petition is accordingly disposed of.
