Through
this constitution petition, petitioner seeks quashment
of FIR No.1423/2023, registered at P.S. KIA, Korangi,
Karachi for offence under Section 9(1)3(b), Control of Narcotic Substances
(Amendment) Act, 2022. Counsel for petitioner submits that challan
has been submitted and he would be satisfied if the directions are issued to
the trial Court for deciding the case expeditiously. Mr. Ali Haider
Saleem,
learned Additional Prosecutor General, present in Court in some other cases,
waives notice and recorded not objection for such directions. Since the challan has already been submitted, alternate remedy is available
to the petitioner, the instant petition is dismissed as not pressed. However,
the trial Court is directed to decide the case expeditiously, preferably within
three months.
