            This constitution petition is filed on behalf of petitioner/accused Faisal Sikandar Dehraj through his son/attorney Hayat Sikandar Dahraj, for seeking protective/transitory bail in FIR No.11/2023, registered at P.S. FIA, Composite Circle, Shaheed Benazirabad for offences under Sections 4(1), 23 FER Act, 1947 (Amended Act, 2020), read with Section 109, PPC. It is inter alia contended that at present petitioner Faisal Sikandar Dehraj is at USA and is prepared to surrender before the trial Court concerned but apprehends his arrest at Karachi Airport at the hands of FIA officials for mala fide reasons, as NBW has been issued against him. Along with petition, photo copy of air-ticket and passport are annexed.

 

Since the petitioner/accused intends to face the trial and is prepared to surrender before the trial Court concerned, without touching the merits of the case, petitioner/accused Faisal Sikandar Dehraj son of Sikandar Ali Dahraj is granted protective/transitory bail for a period of eight (8) days from today in FIR No.11/2023, registered at P.S. FIA, Composite Circle, Shaheed Benazirabad, subject to furnishing solvent surety in the sum of Rs.100,000/- (Rupees One Hundred Thousand) and P.R bond in the like amount to the satisfaction of the Nazir of this Court. Petitioner/accused is directed to surrender before the trial Court concerned in the aforesaid period. Operation of NWB issued against the petitioner/accused is suspended for eight days. This order shall cease to have its effect after expiry of eight days from today or whenever the petitioner/accused surrenders before the trial Court concerned, which one occurs earlier. In case, petitioner fails to surrender before the trial Court within the aforesaid period, his bail bond shall stand automatically forfeited. Let the copy of this order be sent the Secretary, Ministry of Interior, Government of Pakistan, Islamabad by fax for information.

           

            The instant petition is accordingly disposed of.
